General Terms And Conditions

TFHost transfer team will make every effort to assist in moving the Client’s site to them. NOTE: transfers are provided as a courtesy service, and as such the availability, possibility and period on the completion on account transfer cannot be guaranteed. TFHost will give a bonus of free transfer services for 30 days from the sign-up date. However, bonus will only be available for client’s whose previous hosting company is running cPanel. A migration fee will be charged where the previous hosting company of the client’s used non-standard control panel. Transfers outside of the 30-day free period will attract a charge. Kindly contact a member of the transfers department with specific details to receive a price quote.

All services provided by TFHost must only be used for lawful purposes and in accordance with the laws of the Federal Republic of Nigeria.

The customer agrees to indemnify and hold harmless TFHost from:
a) any claims resulting from unauthorized use of the services or illegal use.
b) Illegal use or infringement of any copyright or trademark. This includes but not limited to unauthorized copying of music, books, photographs, or any other copyright work.

Client’s account may be disabled and the contract terminated in the event of the followings;

• Sale of any counterfeit merchandise of a trademark holder.
• Account found to be in violation of another’s copyright. Account found in repeated violation of copyright laws in addition to the termination will be charged an administrative fee.
PLEASE NOTE: that Client may contact Tfhost on copyright infringement and trademark via email admin@tfhost.ng with a valid proof of infringement. However, additional documentation may be required on license issue.
• Any abuse of Tfhost staff in any medium or format will result in the suspension or termination of services without refund.
• Sending out spam account

Shared account as a backup/storage device is not permitted. Any default including cPanel Backups will be automatically deleted from server. The under listed materials are prohibited on Shared and Reseller servers:

TFHost’s services, including all related equipment, networks and network devices are provided only for authorized customer use. TFHost’s systems may be monitored for all lawful purposes, including its use by authorized user or otherwise, Management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security.Information may be examined, recorded, copied and used for authorized purposes. Use of TFHost server(s) constitutes consent to monitoring for these purposes.

TFhost reserves the right to suspend Client’s account with or without notice on the following grounds in the event of the following;

• Any account found connecting to a third party network or system without authorization from the third party.
• Access to networks or systems outside of the client’s direct control. Except with the production of written consent from the third party. TFHost may, at its discretion, request and require prove that access to a third party network or system is authorized. Or refuse service to anyone or material if: obscene, threatening, illegal, or violates the terms of service in any manner from the servers (or otherwise disabled), with or without notice.
In the event of failure to respond to email from Tfhost abuse department within 48 hours. All abuse issues must be dealt with via troubleticket/email and with a response within 48 hours. Any site found to host child pornography or linking to child pornography will be suspended immediately without Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita): If found reselling the account.
Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via troubleticket/email and will have a response within 48 hours.

Sites hosted on TFHost’s service(s) are regulated only by the law of the Federal Republic of Nigeria. Given this fact, Tfhost will not remove allegedly defamatory material from domains hosted on the service(s).

Without prejudice to the Governing law, where materials have been found to be defamatory by a court, as evidenced by a court order. TFHost will not be responsible for any prosecution, to validate or invalidate the veracity of individual defamatory claims. However, in the event of any successful claims of defamatory, libel, or slander, Tfhost reserve the right to disable access to the material. Similarly, in any case in which a Nigerian Court has placed an injunction against specified content or material, TFhost will comply and remove or disable access to the material in question. TFHost are re-publishers and not the publisher of the content. The service merely provides a hosting platform and space on which to host content, and any creation or publication of content on TFhost services is the sole responsibility of the clients which creates or publishes the content. Therefore, TFHost will not be liable for any alleged defamation, offensive or harassment of contents published on sites hosted under TFHost web hosting service(s). Clients are responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. Clients are required to use a secure password. If a weak password is used Client will be notified, for change /update of the password. Account may be suspended until a secured password is used. Periodic Audit may be done to prevent weak passwords from being used. Client shall ensure that scripts/programs installed under their account are secured and permissions of directories are set properly, regardless of installation method. At all possible, set permissions on most directories to 755 or as restrictive as possible. Violations will be reported to the appropriate authorities. Zero Tolerance Spam Policy
TFhost take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists” and purchased lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated and such infracting account holder handed over to the authorities for full prosecution.
Bulk email will only be allowed on VPS platform and must abide by all laws regarding spam, including the CAN-SPAM Act.
TFHost reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
TFHost reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean-up fee or any charges incurred for blacklist removal. This cost of the clean-up fee is entirely at the discretion of TFHost.

Client’s agree to supply appropriate payment for the services received from TFHost, in advance of the time period during which such services are provided. And until and unless TFHost is officially notified in writing of client’s intention to terminate any or all services received, those services will be billed on a recurring basis.
As a client of TFHost, it is the Client’s responsibility to ensure that payment information is up to date, and that all invoices are paid on time.
Clients agree that until and unless TFHost is notified of their intention to terminate /cancel any or all services received (by the proper means listed in the appropriate section of the Terms of Service), those services will be billed on a recurring basis, unless otherwise stated in writing by TFHost. Consequently, TFHost reserves the right to bill Client’s credit card or billing information on file with Tfhost Access to the account will not be restored until payment has been received. If the client has multiple services, Tfhost reserve the right to suspend other services until all services are paid up to date.
Domain renewals are billed and renewed 7 days before the renewal date. No refunds will be given, once a domain is renewed. All domain registrations, and renewals are final.
TFHost reserves the right to review the monthly payment amount and any other charges at any time.

Non-use of Backup is at the client’s sole Risk. As the service is provided to clients as a courtesy. TFHost will not be responsible for files and/or data residing on client’s account. Client’s hereby agree to take full responsibility of files and data transferred and to maintain all appropriate backup of files and data stored on TFHost servers. Clients can generate own backups via the cPanel interface.

TFHost reserves the right to cancel, suspend, or otherwise restrict access to client’s account at any time with or without notice.
Cancellations must be done online, you can cancel your hosting account and your domain registration by sending an email to admin@tfhost.ng
TFHost gives you an unconditional 30-day money back guarantee on managed shared hosting and reseller solutions.
No refunds will be allowed on dedicated (VPS) servers, administrative fees, add-ons such as dedicated IPs, install fees for custom software, or domain name purchases.
Only first-time accounts are eligible for Tfhost our money back guarantee. For example, an old customer who cancelled and signed up again, will not be eligible for a refund or if a second account is opened with Tfhost .
Please Note that no refund will be made after the initial 3days.
NOTE: The refund policy will be waived upon any violation of the Terms of Service.

Dedicated IPs are only to be used for SSL-based websites, you must provide a valid SSL certificate in order to receive a dedicated IP.
User may not: Use 15% or more of system resources for longer than 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP scripts, HTTP, etc.
Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
Run any software that interfaces with an IRC (Internet Relay Chat) network.
Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
Participate in any file-sharing/peer-to-peer activities
Run any gaming servers such as counter-strike, half-life, battlefield1942, etc.
Run cron entries with intervals of less than 15 minutes.
Run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately.
When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”) use include(“include.php”) Inodes
The use of more than 250,000 inodes on any shared account may potentially result with a warning first, and if no action is taken future suspension. Accounts found to be exceeding the 100,000 inode limit will automatically be removed from TFhost backup system to avoid over-use. However, databases will still be backed up. Every file (a webpage, image file, email, etc) on TFhost account uses up 1 inode.
Sites that slightly exceed TFhost inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension. Over time, tens of thousands of messages (or more) build up, eventually pushing the account past Tfhost inode limit. To disable your default mailbox, login to cPanel and choose “Mail”, then “Default Address”, “Set Default Address”, and then type in: :fail: No such user here.

If Client’s shared server has a physical downtime that is not within the 99.9% uptime client’s may receive one month of credit on their account. Approval of the credit is at the discretion of TFHost dependent upon justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor’s network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services. To request a credit, please contact admin@tfhost.ng with justification. All requests must be made in writing via email. Uptime guarantees only apply to shared / reseller solutions.

Resellers are (termination) responsible for supporting their clients. TFHost does not provide support to our Reseller’s Clients. If a reseller’s client contacts us, we reserve the right to place the client account on hold until the reseller can assume their responsibility for their client. All support requests must be made by the reseller on their clients’ behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients’. TFHost will hold any reseller responsible for any of their clients’ actions that violate the law or the terms of service.

Shared (Non-Reseller Accounts): Shared accounts may not resell web hosting to other people, if you wish to resell hosting you must purchase / use a reseller account.

Resellers are (termination) responsible for supporting their clients. TFHost does not provide support to our Reseller’s Clients. If a reseller’s client contacts us, we reserve the right to place the client account on hold until the reseller can assume their responsibility for their client. All support requests must be made by the reseller on their clients’ behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients’. TFHost will hold any reseller responsible for any of their clients’ actions that violate the law or the terms of service.

Shared (Non-Reseller Accounts): Shared accounts may not resell web hosting to other people, if you wish to resell hosting you must purchase / use a reseller account.

PRICE CHANGE
TFhost reserves the right to review prices listed on TFHost, and the right to review the amount of resources given to plans at any time.
Coupons: Discounts and coupon codes are reserved for first-time accounts *or first-time customers* only and may not be used towards the purchase of a domain registration unless otherwise specified. If you have signed up using a particular domain, you may not resign up for that domain using another coupon at a later date. Any account found in violation of these policies will be reviewed by our sales department and the appropriate invoices will be added to the account. Coupon abuse will not be tolerated and may result in the suspension or termination of the account.

Customer agrees that it shall defend, indemnify, save and hold TFHost harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against TFHost, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless TFHost against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with TFHost; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from TFHost’s server.

Arbitration: By using any TFHost services, you agree to submit to binding arbitration. If any disputes or claims arise against TFHost or its subsidiaries, such disputes will be handled by an arbitrator of TFHost’s choice. Arbitrators shall be attorneys or retired judges and shall be selected pursuant to the applicable rules. All decisions rendered by the arbitrator will be binding and final. The arbitrator’s award is final and binding on all parties. Clients are also responsible for any and all costs related to such arbitration.

Disclaimer: TFHOST shall not be responsible for any damages client’s business may suffer. TFHOST makes no warranties of any kind, expressed or implied for services we provide. TFHost disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by TFHost and its employees. (There should be warranty on interruption by Tfhost except the ones beyond their control “force majeure).

Disclosure to Law Enforcement:TFHost may disclose any subscriber information to law enforcement agencies/Court order or as may be stipulated by Nigerian laws without further consent or notification to the subscriber upon lawful request from such agencies. TFHost reserves the right to revise its policies at any time and communicate same to the clients. For further enquiries contact admin@tfhost.ng.

TFhost provides cloud-based solutions, including web hosting, domain name registration and related products and services, to Corporate Bodies, individuals, non-profit organizations and others. As part of Trefoil Networks ("Trefoil Networks"), TFhost provides varieties of products and services to help customers with their technology needs.
The information collected by TFhost in connection with our Services is hosted on servers located in the Federal Republic of Nigeria ("Nigeria"). By using the Services, you freely and expressly give TFhost the consent to export your information and data outside of Nigeria.
Information Collected: The information's collected from clients are used to provide clients with the products and services purchased and for the purposes described below. The information may be received via automated means such as communications profiles or cookies.
Personal Information: The required information depends on the type of service, support, or sales inquiry, and may include your name, address, telephone number, fax number and email address, dates of service provided, types of service provided, payment history, manner of payment, amount of payments, date of payments, domain name, credit card or other payment information. The financial information will only be used to bill the client for the products and services purchased. If a credit card is purchased, the information may be forwarded to the client's credit card provider.

TFHOST will periodically conduct customer surveys. Participation in the client's survey is voluntary. However, users are encouraged and advised to participate in these surveys as they provide TFhost with important information that helps in improving services and how on how the services are provided.

TFhost website includes social media features (such as the Facebook "Like" button). These features may collect client's IP address and page(s) visited on TFhost website, and may set a cookie to enable the feature to function properly. Social media features and widgets may be hosted by a third party or directly on TFhost website. The interactions with these features are governed by the privacy policy of the company providing the features.

This Privacy Policy does not apply to data or personal information that may be submitted to, or collected by, third-party websites hosted by TFhost or to domain names registered by TFhost. Such websites and domain names are not owned or controlled by TFhost. Clients are expected to independently evaluate the privacy policies of such third-party websites before submitting data or personal information to them.

Personal Information: The information collected from customers are used for billing and to provide service and support to customers. TFhost may study this information to determine customers' needs and promote certain products and services or additional support. TFhost may also generate non-identifying and aggregate profiles from information that are provided during registration (such as the total number of customers in a given category). This aggregated and non-identifying information may be used to promote advertisements that appear on the website and services.

TFhost takes reasonable precautions to prevent unauthorized access to customer's information. Accordingly, TFhost may require additional forms of identity in event of request for information about customers account details. TFhost may also use the information provided to TFhost to send monthly newsletter to the primary contact e-mail on file, or to contact customers about other products or services that may be of interest to customers.

TFhost uses IP addresses to analyze trends, administer our site and servers, track access, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. However, it is possible that personal information about a customer may be included in the log files due to the normal functions of IP addresses and Web browsing.

TFhost may use the contact and other information provided to follow up with customers who respond to our customer surveys to help resolve issues internally or with third party partners. For example, TFhost may contact customers based on their survey answers or to highlight certain changes made in response to customer feedback.

Partners and Sponsors: Some TFhost products or services are offered or promoted to customers in conjunction with a partner or sponsor, or another brand or company within TFhost Corporate family. TFhost may share your information with these parties to offer the product or service or to facilitate customers use of additional amenities included with customers hosting account. For example, one of TFhost partners may provide services to customers based on links accessed from control panel.
We may also disclose aggregate, anonymous data based on information collected from users to potential partners, reputable third parties and other companies or brands within our corporate family. Customers Information will only be shared with third parties that agree to maintain the information in confidence and to use it solely for purposes of providing the product or service as agreed to by TFhost

TFhost may transfer (or otherwise make available) personal information to third parties that help provide services or provide services on TFhost behalf. For example, TFhost may use service providers to authorize and process payments, administer surveys, or run promotions. Customer's personal information may be maintained and processed by our third party service providers in the United States or in other jurisdictions. TFhost service providers are given necessary information to perform their designated functions.

TFhost do not share personal identifiable information about individual customers with advertisers. Though TFhost may display online advertisements and share aggregated and non-identifying information about customers collected through the registration process or through online surveys and promotions with certain advertisers. In some instances, this aggregated and non-identifying information are used to deliver tailored advertisements. For example, an advertiser may tell us the audience they want to reach (e.g., males between 25 and 55 years of age) and provide us with an advertisement tailored to the audience. Based upon the aggregated and non-identifying information we have collected, we may then display the advertisement to the intended audience. (Not necessary).

TFhost may share customer information obtained from customer surveys within TFhost and their corporate family, and with trusted third parties to develop or provide products and services that may be of interest to customers.

In certain jurisdictions or pursuant to the rules of the Internet Corporation for Assigned Names and Numbers ("ICANN") or certain registries, the contact information provided by customers to register a domain name ("Domain Name Registration Information") has to be made available and accessible to the public through a "WHOIS" search. The WHOIS database is a publicly accessible database that lists the Domain Name Registration Information for a particular domain name, the name server(s) to which the domain name points, and the domain name's creation and expiration date. TFhost may also deposit customer's Domain Name Registration Information with a third-party escrow provider to comply with ICANN requirements.

The Domain Name Registration Information provided is hosted by TFhost or a third party service provider and is made available to the public through WHOIS searches. However, customer may receive solicitations that result from searches of the publicly available WHOIS database by other companies or individuals. Any such solicitations or SPAM do not come from TFhost and TFhost do not control the use of WHOIS information by third parties. Further, pursuant to ICANN rules, TFhost is required to make WHOIS data available to any third party that enters into a bulk access agreement. While ICANN allows individuals to opt-out (using the account management panel, domain management console or similar service) of having their WHOIS information made available to third parties through bulk access, companies, such as ours, businesses, and other organizations do not have the ability to opt-out of having their information made available to a third party that enters a bulk access agreement.

TFhost may access, preserve and share information about customers with companies, organizations, governmental entities or individuals outside of TFhost in good faith, and as may be required by law. This may include, but not limited to, responding to subpoenas, court orders or other legal processes (such as law enforcement requests). TFhost may also access, preserve and share information about customers as necessary to: (i) establish or exercise TFhost's legal rights or defend against any legal claim including threatened claims involving TFhost based on the anonymity of a domain name; (ii) investigate, prevent, or take action regarding suspected fraud or other illegal activities; (iii) prevent death or serious physical harm to any person; or (iv) investigate violations of TFhost's Terms of Service.

Amendment /Updating Personal Information: If a customer's information changes, or if a customer no longer requires the services, TFhost may provide a way to correct, update or remove that customer's personal data from the records. In most cases, this can be achieved by emailing us at support@TFhost.ng.

By default, customers will receive invoices, system updates, TFhost newsletters and other mailings. Customer may opt out of newsletters and mailings by using the unsubscribe link in any promotional email or as otherwise provided in the communication. Please note that customers may not opt out of receiving important system notifications or emails about their accounts.

Any information disclose or posted on public areas of TFhost websites or the Internet, becomes public information. Customers are advised to exercise caution in disclosing personal information in the public areas. Request for removal of personal information from our community forums or testimonials, contact us at support@TFhost.ng. TFhost may not be able to remove your personal information, in which case a feedback will be sent to the customer.

TFhost uses technical security measures to prevent the loss, misuse, alternation or unauthorized disclosure of information under our control. TFhost uses security measures including and not limited to: physical, electronic and managerial procedures to safeguard and secure the information collected online. All sensitive information is collected on a secure server. Financial information (such as a credit card number) provided by customers are protected using Secure Sockets Layer ("SSL") technology.

This website is not directed towards children and do not require personal information from children under the age of 15. Any personal information from a child under the age of 15 will be deleted from TFhost database

In addition to all of the terms and conditions set forth above, the following terms apply to Reseller relationships only. Information Related to Data Collected through Resellers. TFhost may collect information under the direction of its Resellers, without direct relationship with individuals whose personal data is provided, processed or obtained by the Resellers. Customers who seek access, or who seek to correct, amend, or delete inaccurate data are required to direct their query to the Reseller's data controller. If the Reseller requests that we remove the data, we will respond to such request within thirty (30) business days.

A customer of our Resellers and would no longer like to be contacted by such Reseller, please contact the Reseller from whom you purchased products or services.

TFhost retain personal data to process on behalf of the Resellers for as may be required to provide services under the relationship. The personal information will be retained as necessary to comply with the legal obligations, resolve disputes, and enforce our agreements.

TFhost reserves the right to revise, amend, or modify this Privacy Policy at any time and in any manner. However, customers will be contacted in the event of material changes with an advance notice prior to the change becoming effective and an opportunity to opt-out of such differing uses.
